Background eligibility

BATFE pre-screening

Southwest Energy, LLC is involved in the handling, storage, and use of explosive materials. As a result, federal law (the Safe Explosives Act, 18 U.S.C. § 842(i)) requires that all employees be cleared through a background check conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) before they may lawfully possess explosive materials on the job.

As part of that background check, BATFE will screen for factors including whether a person:

Has been convicted of a crime for which the judge could have imprisoned them for more than one year, even if a shorter sentence (including probation) was actually given
Is currently under indictment for such a crime
Was discharged from the Armed Forces under dishonorable conditions
Is a fugitive from justice, an unlawful user of or addicted to a controlled substance, an undocumented immigrant, or has renounced U.S. citizenship
Has been adjudicated as a mental defective or committed to a mental institution
Is subject to a court order restraining harassment, stalking, or threats against an intimate partner or child, or has been convicted of a misdemeanor crime of domestic violence
